These Terms and Conditions (“Terms”, “Agreement”) govern your participation in the Wilson’s Foods Affiliate Program (“Program”). By registering as an Affiliate, you agree to be bound by these Terms.

“Wilson’s Foods”, “we”, “us”, and “our” refer to Wilson’s Foods and affiliated entities. “You” and “your” refer to the individual or business participating in the Program.

We may update these Terms at any time. Continued participation in the Program constitutes acceptance of revised Terms.

1. Account Terms

  • You must be 18 years or older to participate.
  • You must reside in a region where affiliate participation is legal.
  • Accounts created by automated systems (bots) are prohibited.
  • You must provide accurate registration information including your full name and valid email.
  • Each account may only be used by one individual—shared accounts are not allowed.
  • You are responsible for maintaining the security of your login credentials.
  • You are accountable for all activity under your account.
  • You may not operate more than one affiliate account without written permission.
  • You may not use the Program for unlawful purposes or violations of any applicable laws.
  • You may not use affiliate links to earn commissions on your own purchases.

2. Affiliate Links & Promotional Material

After approval, you will receive a unique Affiliate Code. You may place promotional links, banners, and graphics containing this code on your website, emails, and supported channels.

  • We provide branded materials and link formats which may be updated from time to time.
  • Your Affiliate Links must correctly use our tracking format (“Special Links”).
  • We are not responsible for tracking failures caused by incorrect link usage, browser issues, or user error.
  • Affiliate Links must direct users to the correct Wilson’s Foods product or landing page.
  • Prohibited behaviours include:
    • Misleading or cloaked links
    • Cookie stuffing
    • Hidden iframes
    • Bidding on Wilson’s Foods brand names in ads
    • Registering domain names resembling our trademarks

3. Commissions & Payments

To qualify for commission:

  • The customer must click your Special Link and complete a purchase at https://trade.oliveoil.co.za.
  • The purchase must occur within the same tracked session or cookie window (if applicable).
  • Only automatically tracked sales are eligible—no manual corrections will be made.

We reserve the right to reject commissions resulting from:

  • fraudulent or suspicious activity
  • cancelled or refunded orders
  • misleading or aggressive marketing practices

Commission Threshold: Payments begin once your balance exceeds [insert threshold e.g., R350].

Payment Schedule: Approved commissions are paid monthly, subject to validation checks.

Taxes: You are responsible for reporting and paying any taxes required in your region.

4. Identifying Yourself as a Wilson’s Foods Affiliate

  • You may not claim to represent Wilson’s Foods or present yourself as an employee.
  • You may not issue press releases referencing the Program without permission.
  • You may not imply endorsement, partnership, or sponsorship unless explicitly permitted.
  • You may not purchase products for personal use via your own Affiliate Links.

5. Customer Ownership

Customers who purchase via your Affiliate Links are considered customers of Wilson’s Foods. All policies related to customer orders, pricing, and support apply to these customers.

6. Your Responsibilities

You are solely responsible for:

  • Operating and maintaining your website or promotional channels
  • Ensuring your content does not infringe on copyrights, trademarks, or privacy rights
  • Accurate representation of products and truthful marketing practices
  • Compliance with privacy laws and cookie disclosure requirements
  • Honest and legal promotional activities

7. Compliance with Laws

You agree to comply with all applicable laws including advertising, consumer protection, marketing practices, and anti-spam regulations (e.g., POPIA, GDPR, CAN-SPAM).

8. Term & Termination

  • Either party may terminate this Agreement at any time, with or without cause.
  • Upon termination, you must remove all Affiliate Links and promotional materials.
  • Wilson’s Foods may terminate accounts for misuse, fraud, or policy violations.
  • Any unpaid commissions above the threshold will be paid after termination.

9. Relationship of Parties

Nothing in this Agreement creates a partnership, joint venture, employment, or agency relationship. You may not accept offers or make statements on Wilson’s Foods’ behalf.

10. Limitation of Liability

Wilson’s Foods is not liable for indirect, incidental, or consequential damages including loss of revenue, profits, or data. Our total liability shall not exceed the total commissions paid to you.

11. Disclaimers

We make no guarantees regarding uninterrupted service, error-free tracking, or specific earnings. We do not guarantee product availability or pricing stability.

12. Arbitration

Any disputes arising out of this Agreement shall be resolved through confidential arbitration, except where legal action is required to protect Wilson’s Foods’ intellectual property.

13. Miscellaneous

  • This Agreement is governed by the laws of [insert applicable region/country].
  • You may not assign your rights without written permission.
  • Failure to enforce any provision is not a waiver of that provision.
  • This Agreement constitutes the entire understanding between both parties.

By participating in the Wilson’s Foods Affiliate Program, you acknowledge that you have read, understood, and agree to all Terms contained herein.
